The Entry Permit is a certificate issued by the General Directorate of Residence and Foreigners Affairs - Dubai (“GDRFAD”), through DMCA, indicating that the personal documents submitted by the applicant have been verified, and he is permitted into the United Arab Emirates for a specified period of time, for employment. The permit is provisional and subject to approval by the authorised officer at the point of entry. It allows entry via Dubai airports only, providing that the passport shall be valid for not less than three months on arrival at the point of entry. Permit details shall be typed electronically, and obtaining an original copy is required to enter the United Arab Emirates through other points of entry.

Employment Contract Termination and End of Service

Employment Contract Termination for Employee within UAE

The employee shall complete the contract term as agreed, and if either party wishes to terminate the contract, the following rules shall be considered:

  1. During the probation period, both employer and employee may terminate the contract without prior notice.
  2. Once the probationary period completed satisfactorily, both employer and employee may terminate the contract at any time with a prior written notice before the set termination date, within a period agreed upon by the two parties, providing that it may not be less than one month or more than three months. Both parties shall comply with the employment contract during notification period.
  3. The establishment/company shall apply for employment contract termination within enough time before the residence visa expiry date. The establishment/company shall ensure dependents visas have been cancelled, attach copy of GDRFAD the approved visa cancellation form and the employee has left the UAE or got a new job within the specified period of (28) days from cancellation date.
  4. The company shall refer to UAE applicable Labour Law to compute the employee’s end of service benefits.

End of Service Benefits

The general rules of end of service benefits are as follows:

  1. Benefits and dues on basic salary basis.
  2. Annual leave dues on basic salary basis.
  3. Benefits and entitlements are payable after completion of at least one year from employment contract date.

Stages of Employment Contract Termination

After completing all requirements, termination of employment contract is conducted in two stages as follows:

First Stage:

  1. Submittal of required documents as well as payment of contract termination fees.
  2. Receiving the original copy of GDRFAD approved employee’s residence visa cancellation.

Required Documents:

  1. Service Termination request letter from company.
  2. Filling the service termination application form
  3. Original copy of employee’s labour card.
  4. Employee’s original valid passport and Emirates ID card.
  5. Copy of return ticket if the employee wishes to leave UAE.
  6. Copy of initial approval or employment visa if the employee wishes to get a new job opportunity in UAE.

Second Stage:

After completing all required documents, employee’s service termination request will be approved by GDRFAD, and copy of the approved cancellation form along with the employee’s original passport will be given to the company, so that he can leave UAE or get a new job opportunity. The company shall notify DMCA of the date the employee leaves UAE and provide copy of exit stamp issued by GDRFAD – airport

Employment Contract Termination for Employee Out of UAE

The company shall apply for employment contract termination for an employee out of UAE provided that the company obtains the employee’s approval and delivers his original passport to DMCA. In case the original passport cannot be provided, the company shall provide exit certificate from GDRFAD proving that the employee has been out of UAE for 6 months.

Stages of Employment Contract Termination:

After completing all requirements, termination of employment contract is conducted in two stages as follows:

First Stage:

  1. Submittal of required documents as well as payment of contract termination fees.
  2. Receiving the original copy of GDRFAD approved employee’s residence visa cancellation.

Required Documents:

  1. Service Termination request letter from company.
  2. Filling the service termination application form
  3. Original copy of employee’s labour card.
  4. Copy of employee’s passport and residence visa as well as copy of Emirates ID card in case of failing to furnish the original passport.
  5. UAE exit certificate from GDRFAD.

Second Stage:

After completing all required documents, employee’s service termination request will be approved by GDRFAD, and copy of the approved cancellation form will be given to the company.

Employment Residence Visa Issuance

Employment Residence Visa Issuance for employee out of UAE

After satisfying all requirements, residence visa issuance for employee out of UAE is conducted in three stages as follows:

First Stage: entry visa issuance

  1. Submittal of initial documents for entry visa issuance, in addition to residence fees and bank guarantee.
  2. Issuance of entry visa after obtaining GDRFAD approval.

Required Documents

  1. Visa request letter from Company.
  2. Filling visa application form no.
  3. Attested copy of educational qualifications or university certificates (for high management positions).
  4. 8 coloured photographs with white background.
  5. Copy of employee’s passport valid for not less than (3) months.

After obtaining GDRFAD approval, the employment visa will be issued electronically for 60 days as of issuance date and the employee shall use it to enter the United Arab Emirates through Dubai international airports only. To enter through the other emirates, the company shall apply for an original entry visa.

Second Stage:  medical check-up

After the employee has entered the UAE, the establishment/company shall provide all required documents within a period of not more than (3) workdays. Employment visa is valid for (30) days as of entry date and commencement of Emirates ID card issuance procedures.

Required Documents:

  1. Employee original passport valid for not less than 3 months.
  2. Copy of GDRFAD approved employment visa -airport.
  3. Copy of Emirate ID card application.
  4. Three copies of employment contract approved by the employee and an authorized individual in the Company/ form no.

After receiving all required documents, the medical card shall be issued and check-up date booked, and then the employee shall approach one of the approved medical centres to finish his medical, collect the report and present it to DMCA for final residence visa procedures.

Third Stage: employment residence visa stamping

After obtaining the medical check-up report, residence visa shall be stamped on passport and valid for three years as of issuance date, labour card will be issued and employment contract attested, then company shall provide copy of Emirates ID card upon receiving it.

After obtaining GDRFAD approval, employment visa will be issued electronically, status adjustment procedures will commence, and then medical check-up procedures can be completed.

Second Stage:  medical check-up:

After receiving all required documents, the medical card shall be issued and check-up date booked, and then the employee shall approach one of the approved medical centres to finish his medical, collect the report and present it to DMCA for final residence visa procedures.

Amendment of Residence Visa and Employment Contract Details

Amendment of Employee’s Personal Details

  1. Submittal of required documents as well as amendment fees.
  2. Employment visa details amendment and issuance of labour card and employment contract.

Required Documents:

  1. Amendment request letter from company.
  2. Filling employment contract details amendment application form
  3. Original copy of employee’s labour card issued by DMCA.
  4. Original employee’s passport valid for not less than (3) months.
  5. New original passport in case of transferring employment visa to a new passport.
  6. Copy of Emirati ID card.
  7. Original approval letter of name or nationality change attested by the competent authority.
  8. Attested copy of educational qualifications or university certificate (for high management positions).
  9. 8 coloured photographs with white background.
  10. Copy of Emirates ID Card details amendment form.
  11. Three copies of employment contract signed by the employee and an authorised individual in the company/ form

After completing all required documents, residence visa details will be amended, or residence visa transferred to the new passport and will still be valid through the remaining period, until expired. Additionally, a new labour card will be issued, employment contract attested, and then company shall provide copy of Emirate ID card upon receiving it.

  1. Amendment request letter from Company.
  2. Filling employment contract details amendment request form no.

  7. Paying the bank guarantee difference in case of basic salary amendment.

Employment Residence Visa Renewal

After completing all requirements, residence visa renewal is conducted in two stages as follows:

Required Documents:

  1. Establishment/Company request letter.
  2.  Original copy of entry visa.
  3. Copy of employee valid passport.

Employment Visa Cancellation

Establishments/companies shall apply for cancellation of entry permit one week prior to expiry explaining the reasons for cancellation.

Required Documents:

  1. Establishment/Company cancellation request letter.
  2.  Original copy of employment entry visa.
  3. Copy of employee valid passport.
  4. Copy of return ticket in case the employee is within UAE.

Public Relations Officer’s Card

Public relation officers (PROs) are agents representing establishments/companies at DMCA. They are authorised to submit and/or receive documents on their behalf, and their card shall be as valid as the employment visa. PROs are classified in two categories:

  1. Sponsored employee by the establishment/company.
  2. Sponsored employee by others.

Required Documents:

  1. Request letter from establishment/company
  2. Filling PRO application form
  3. Copy of valid passport, residence visa and Emirates ID card.
  4. 2 coloured photographs with white background.
  5. NOC from current sponsor in case sponsor is a different company.

After completing all required documents, the PRO card will be issued and given to the establishment/company.

Health Card Renewal

Required Documents

  1. Request letter from establishment/company.
  2. Copy of valid passport, residence visa and Emirates ID card.
  3. Original health card.
  4. 2 coloured photographs with white background.

Lost Health Card Replacement

In case of damage or loss of health card, the employee shall notify DMCA and apply for card replacement.

Required Document

  1. Request letter from establishment/company.
  2. Copy of valid passport, residence and Emirates ID card.
  3. Original health card in case of damage.
  4. 2 coloured photographs with white background.

Absconding Report Issuance

Establishments/companies shall apply for absconding report against employees if they absent themselves from work for a period of more than 3 months.

Required Documents

  1. Absconding report issuance request letter from Establishment/company.
  2. Resident original copy of entry/exit certificate issued by GDRFAD – airport.
  3. Copy of employee’s valid passport, residence visa and Emirates ID Card.

Absconding Report Cancellation

It may be applied upon settling the disputed claim or expiring residence visa of absconding employee. Renewal of residence permit for previously reported absconding employee is not allowed. Cancellation process will be conducted within (3) months from the absconding report issuance.

Required Documents

  1. Absconding report cancellation request letter from company.
  2. Copy of employee’s valid passport, residence visa and Emirates ID Card.

Letters & Certificates

Establishment/company shall apply for “To Whom It May Concern” letters at the competent authorities detailing the purpose of the letter.

Types of Letters Issued by DMCA:

  1. Employment certificate.
  2. No-objection letter to obtain driving license.
  3. No-objection letter to enter ports or free zones.
  4. No-objection letter to leave UAE via sea ports.
  5. No-objection letter to obtain spiritual drinks permit.
  6. Letter of lost official documents.
  7. No-objection letter to issue visit visa for a visitor from another country.

Required Documents:

  1. Request letter from company.
  2. Copy of employee’s valid passport, residence visa and Emirates ID Card.

After completing all required documents, “To Whom It May Concern” certificate will be issued valid for one month only as of issuance date.

Bank Guarantee Refund

Establishments/companies shall apply for bank guarantee refund after completing the employee’s visa cancellation procedures and ensuring that he has left UAE.

Required Documents

  1. Request letter from establishment/company.
  2. Original copy of bank guarantees.
  3. Copy of employee’s passport and cancelled residence visa.
  4. Copy of exit stamp issued by GDRFAD – airport, or copy of new employment visa if the employee has got a new job opportunity in UAE.
  5. Copy of company’s account statement declaring account number and (IBAN).

Upon satisfying all required documents, bank guarantee amount will be transferred to the company’s account within a period of not less than 45 working days.

 

 

Sponsorship Transfer Services

Sponsorship Transfer from Government Sector to DMCA

Stages of Employee Sponsorship Transfer:

After completing all requirements, sponsorship transfer is conducted in two stages as follows:

First Stage: medical check-up

  1. Submittal of required documents along with sponsorship transfer fees and bank guarantee.
  2. Issuance or renewal of health card and booking medical check-up date.

Required Documents:

  1. Company request letter.
  2. Filling visa application form
  3. NOC from current employer and copy of valid establishment card.
  4. Attested copy of educational qualifications or university certificates (for high management positions).
  5. 8 coloured photographs with white background.
  6. Copy of employee’s passport valid for not less than (3) months.
  7. Three copies of employment contract signed by the employee and an authorised individual in the company/ form

After completing all required documents, sponsorship transfer application will be issued by GDRFAD and copy will be sent to the company, to obtain government authority approval (the current sponsor).

In addition, the health card will be issued or renewed, medical check-up date booked, and then the employee shall approach one of the approved medical centres to finish his medical, collect the report and present it to DMCA for final residence visa procedures.

Second Stage: employment residence visa stamping

After obtaining the report, residence visa shall be stamped on passport and valid for three years as of issuance date, labour card will be issued and employment contract attested, and then company shall provide copy of Emirates ID card upon receiving it.

Sponsorship Transfer from Husband/Father to DMCA

After completing all requirements, sponsorship transfer is conducted in two stages as follows:

First Stage: medical check-up

  1. Submittal of required documents along with sponsorship transfer fees and bank guarantee.
  2. Issuance or renewal of health card and booking medical check-up date.

  1. Sponsorship transfer request letter from the establishment/ company.
  2. Filling visa application form no
  3. Attested copy of educational qualifications or university certificates (for high management positions).
  4. NOC from current employer and copy of valid establishment card.
  5. Copy of sponsor’s passport and valid residence visa for not less than (6) months.
  6. 8 coloured photographs with white background.
  7. Employee’s original passport valid for not less than (3) months.
  8. Employee’s original Emirates ID card.
  9. Original health card (If available).
  10. Three copies of employment contract signed by the employee and an authorised individual in the company/ form

After completing all required documents, employee sponsorship transfer application will be issued by GDRFAD and copy will be sent to the company, to obtain government authority approval (the current sponsor).

In addition, the health card will be issued or renewed, medical check-up date booked, and then the employee shall approach one of the approved medical centres to finish his medical, collect the report and present it to DMCA for final residence visa procedures.

Sponsorship Transfer from DMCA to Government Sector

After completing all requirements, employee sponsorship transfer to the government sector shall conducted in one single stage providing that all requirements shall be satisfied..

Required Documents:

  1. Sponsorship transfer request letter from the establishment/company.
  2. Filling end of service application form
  3. Original copy of sponsorship transfer request issued by GDRFAD and approved by the new sponsor.
  4. Copy of employee passport and valid residence visa.
  5. Copy of Emirates ID card.
  6. Original copy of DMCA labour card.
  7. Copy of commercial license and establishment card of new sponsor.

After completing all required documents, sponsorship transfer request will be approved by GDRFAD and copy will be sent to establishment/company to complete sponsorship transfer procedures.

Sponsorship Transfer within DMCA Companies

To apply for sponsorship transfer within DMCA companies, both companies shall provide the required sponsorship transfer documents at the same time. The current sponsor may refuse sponsorship transfer, if the employee has not completed one year at the job, noting that employment contract details may be amended before starting sponsorship transfer procedures.

DMCA authorise employees working her licensed companies to apply for residence visas, or short or long term visit visas provided that they obtain prior approvals from their companies and satisfy all requirements applicable by GDRFAD.

Stages of Residence Visa Issuance for Dependents out of UAE

After satisfying all requirements, residence visa issuance for dependents out of UAE is conducted in three stages as follows:

First Stage: entry visa issuance

  1. Submittal of initial documents for entry visa issuance along with residency fees.
  2. Issuance of entry visa after obtaining GDRFAD approval.

Required Documents:

  1. No-objection letter from establishment/company.
  2. Request letter from sponsor.
  3. Copy of sponsor’s passport, residence visa and Emirates ID card.
  4. Filling dependents residence visa application form
  5. 8 coloured photographs with white background for the dependent.
  6. Copy of dependent’s valid passport.
  7. Copy of tenancy contract (Ejari).
  8. Copy of Dubai Electricity and Water Authority (DEWA) bill for three months.
  9. Copy of E-Gate card.
  10. Original marriage certificate attested by the competent authorities in case of wife sponsorship.
  11. Original birth certificate attested by the competent authorities in case of children sponsorship.
  12. Original education certificates attested by the competent authorities in case of sons’ sponsorship over 18 years of age.
  13. Original single status acknowledgment certificate attested by the competent authorities in case of daughters’ sponsorship over 18 years of age.

After completing all required documents, dependents’ residence visa application form shall be prepared and the original copy will be given to the sponsor for signature. After obtaining GDRFAD approval, the e-Visa will be issued for 60 days from issuance date.

Second Stage: Medical Check-Up

After the dependent has entered the UAE, sponsor shall provide all required documents within a period of not more than (3) workdays. Employment visa will be valid for (30) days from date of entry, and commencement of Emirates ID card issuance procedures.

Required Documents:

  1. Dependent’s original passport valid for not less than 3 months.
  2. Copy of GDRFAD approved entry visa - airport.
  3. Copy of processed Emirates ID card application.

After receiving all required documents, the health card will be issued, medical check-up date booked, and then the dependent shall visit one of the approved medical centres in the emirate to complete the check-up, receive the medical report and deliver it to DMCA in order to complete residence visa procedures. All children under 18 years of age are exempted.

Status amendment application form will be prepared, and original copy will be given to the sponsor for signature, and then submitted to GDRFAD.

Second Stage: medical check-up

  3. Dependent`s original passport and Emirates ID card.

In case dependents are out of UAE:

  1.   Dependent`s original passport and Emirates ID card (If possible).
  2.  GDRFAD issued exit certificate.
  3. Copy of passport, residence visa and Emirates ID card in case of failing to furnish the original passport.

After completing all required documents, the cancellation application form shall be prepared and original copy will be given to the sponsor for signature. After obtaining GDRFAD approval, residence visa will be cancelled, and copy of the certified cancellation form will be given to the sponsor.

Visit Visa Issuance for Dependents

Sponsor’s Obligations

Sponsor shall be obliged to:

  1. Sponsor shall ensure that visitor departs within the validity of visit visa term period, to avoid overstaying. In case of exceeding the permitted visa period, sponsor shall be responsible to furnish letter of discharge within one week of overstay notification. When this period ends, sponsor shall be subject to a fine of AED 10,000.
  2. Submittal of GDRFAD issued exit certificate.

Short/Long Term Visit Visa Entry Permit

The Entry Permit is a certificate issued by the General Directorate of Residence and Foreigners Affairs - Dubai (“GDRFAD”), indicating that the personal documents submitted by the applicant have been verified, and that he has been issued permission to enter UAE for temporary residence, within a specified period (30/90 days) short / long term. The permit will be for discussions, negotiations or presentations with the client who requested the permission for the visitor and will not include employment emphatically. This permit is provisional and subject to approval by the authorised officer at the point of entry. It is valid for entry through Dubai airports only, since the details have been fed electronically. The original pink visa copy will be required in case of entry through any other UAE airport, and can be arranged by written notice 3 days in advance. To enter UAE, visitors shall hold valid passport or approved travel document for not less than three months, as well as return ticket to the country of origin or place of issue of passport or travel document.
